What happens to a Highly Skilled Migrant permit after job loss?
Your Dutch residence right does not normally disappear on the last working day. The IND gives a limited period to find qualifying employment, but the deadline depends on how long you have held the permit and when the residence card expires.
Direct answer
The search period begins on the legal date your employment contract ends. Your former recognised sponsor normally reports the end of work to the IND within four weeks. A new role must meet the HSM conditions, including employment with an IND-recognised sponsor, the salary criterion applicable on the new start date and a market-rate salary. If the period ends without a qualifying new sponsor, the IND may revoke the permit.

The date that controls the search period
The IND says the clock starts on the day the contract ends. That can differ from the day you stop performing work. During notice or garden leave, the employment relationship may continue and salary may continue. The signed contract, dismissal letter or settlement agreement should therefore state an unambiguous legal end date.
Do not negotiate only the severance amount. The end date affects immigration, WW timing and the expat scheme. A shortened notice period can create an income gap before WW begins and can also bring the IND deadline forward.
A lump-sum payment, unused holiday payout or negotiated compensation is not the same as continuing qualifying HSM employment.
Moving to a new recognised sponsor
- Confirm the employer appears in the IND public register for work.
- Confirm the gross monthly salary and allowances counted by the IND meet the criterion applicable on the new start date.
- Confirm the salary is market-rate for the role.
- Give the new sponsor your permit details, employment-end date and prior sponsor information.
- Ask for written confirmation that the employer has completed the required IND notification or application before relying on the start.
For an HSM permit that remains valid, the IND describes a change of employer as a change that is generally notified rather than a completely new residence route. An extension or new application may still be needed if the permit is close to expiry or another residence purpose is selected.
Can you freelance or work outside the HSM route?
The HSM residence card permits self-employed work alongside the HSM status, but the IND states that a person intending to work only as self-employed should apply for the appropriate self-employed or start-up permit. Ordinary employment outside the HSM conditions may require a TWV unless the card has unrestricted labour-market wording. Do not use freelance income as an assumed substitute for a new recognised sponsor.
WW unemployment benefit
WW is an employee-insurance assessment by UWV. It is separate from immigration. UWV generally checks unemployment insurance coverage, work in at least 26 of the previous 36 weeks, sufficient loss of working hours and income, availability for work and whether you caused your own unemployment. Apply no later than one week after unemployment where possible.
WW may last longer or shorter than the IND search window. Receiving WW does not extend the HSM search period or replace the requirement to find qualifying work.
Partner and children
Family residence permits linked to the HSM holder do not normally vanish automatically on the contract-end date, but their basis depends on the principal permit. The partner permit usually shares the principal permit's end date, and the partner is generally free to work while the family permit remains valid. Unemployment and loss of the income condition can be reportable changes. Review whether a partner independently qualifies for permanent residence, another work route or a different family basis.
The 30% ruling has a shorter switch deadline
The immigration search period can now be six months for some HSM holders, but the expat scheme does not automatically follow that longer period. For a new employer outside the same connected group of withholding agents, the Tax Administration says the new employment must start within three months after the old job ends. The new request should be submitted within four months after starting to preserve use from the first working day.
Permanent residence and naturalisation
Job loss does not erase residence already accumulated. The risk is a later residence gap, permit withdrawal, failure to meet the current income test at application, or moving main residence abroad. If you are near five years, compare an HSM employer switch with a permanent-residence application and have the exact permit history audited before the search period ends.
Employer bankruptcy or sponsor-recognition problems
If an employer cannot pay wages, UWV may provide an insolvency benefit for defined unpaid wage, notice and final-pay periods. If the IND withdraws the employer's recognised-sponsor status and the worker was not involved or aware of the reason, the IND describes a specific three-month period to find another recognised sponsor. That scenario should not be casually merged with the ordinary HSM unemployment rule.
