What happens to partner and children permits after HSM job loss?
The family cards do not normally disappear on the employment end date, but their residence basis is linked to the principal highly skilled migrant permit and must be actively protected.
What remains true initially
- The partner permit normally has the same end date as the temporary permit of the HSM sponsor.
- A partner of a highly skilled migrant is generally free to work while the residence document remains valid.
- The principal HSM search period still governs the vulnerability of the family route.
- Changes that affect the permit conditions, including unemployment and loss of income, can trigger notification obligations.
What can happen if no new sponsor is found
If the IND revokes or does not extend the principal HSM permit, linked family permits can also be affected because their purpose is residence with that sponsor. The IND assesses the actual family route, validity and individual circumstances. Do not wait for all cards to expire before reviewing alternatives.
Independent options for the partner
Permanent residence
A partner with five years of qualifying residence can apply independently if the individual residence, income, BRP and integration requirements are met.
Own work route
A partner with qualifying employment may move to an HSM, EU Blue Card or other work permit based on their own employer and conditions.
Dutch or EU family route
If the family circumstances include a Dutch or EU citizen, a different national-law or EU-law route may apply.
Humanitarian route
Relationship breakdown, domestic violence or special family circumstances can require an independent humanitarian assessment.
Study or self-employment
A genuinely qualifying study, start-up or self-employed route may be possible but has separate conditions.
Children's position
Minor children usually remain linked to the parent route, but Dutch nationality, custody or best-interest factors can materially change the analysis.
Family action file
- Record every family member's permit type, card expiry and V-number.
- Check whether the partner has reached five years independently of the principal applicant.
- Save marriage, birth, custody and BRP records.
- Document the partner's employment and income.
- Check school, insurance and travel consequences before any departure.
- Notify the IND of reportable changes within the required period.
Free work rights on a partner card are valuable, but the residence purpose remains family unless a different permit is approved.
