Is the HSM job-search period 3 months or 6 months?

4 min read2 cited sourcesReviewed 2026-07-31

The six-month maximum applies only when employment ended on or after 22 May 2026 and the highly skilled migrant permit had already been held for at least two years. Earlier employment endings remain subject to a maximum of three months. The residence-card expiry date can shorten either window.

Quick answerUse three inputs only: the legal contract end date, how long you had held the HSM permit on that date, and the residence permit expiry date. The new 6-month maximum is not retroactive to job losses before 22 May 2026.

3 or 6 months: decision tree

Did the employment contract end before 22 May 2026?Maximum search period: 3 months, even if you had already held the HSM permit for 2 years or longer.
Did employment end on or after 22 May 2026?Check how long the HSM permit had been held on the contract end date.
Permit held at least 2 years?Maximum search period: 6 months. If under 2 years, maximum: 3 months.
Does the residence permit expire earlier? The search period cannot run beyond permit validity. Use the earlier date as the practical deadline unless another status or extension is secured.

The calculation

Start with the legal employment end date. If it is before 22 May 2026, add no more than three calendar months, even when the HSM permit had been held for two years or longer. If employment ended on or after 22 May 2026, add six months only when the permit had already been held for at least two years; otherwise add three months. Compare that result with the residence-card expiry date. The earlier date is the practical final date because the search period cannot extend beyond permit validity.

SituationIndicative outcome
Permit held 3 years; contract ended 1 May 2026; card valid next yearUp to 3 months, because employment ended before 22 May 2026.
Permit held 18 months; contract ends 15 August 2026; card valid next yearUp to 3 months, because the permit had not yet been held for 2 years.
Permit held 3 years; contract ends 15 August 2026; card valid next yearUp to 6 months: both post-transition conditions are met.
Permit held 3 years; contract ends 15 August 2026; card expires 30 September 2026The card expiry shortens the six-month rule window to 30 September 2026 unless an extension or new status is secured.

Last working day versus contract end date

The clock does not necessarily begin when access is removed, handover ends or garden leave starts. It begins when the employment contract legally ends. Ask for the signed termination document and check that HR, payroll and immigration records use the same date.

Does the permit remain valid during the search period?

The card can remain physically valid while the HSM employment condition is no longer met. The IND has the power to revoke after the search period. Keep evidence of the contract end, active applications and the new sponsor's notification. Do not interpret an unexpired plastic card as unlimited permission to wait.

Travel during the search period

A valid card can normally support return travel, but travel becomes risky when the permit is close to expiry, an IND withdrawal decision has been issued, or a new employer process is incomplete. Airline boarding, border entry and residence entitlement are separate checks. Confirm the status before leaving the Netherlands near a deadline.

What ends the uncertainty?

WW does not pause the clock.

The UWV benefit period is a separate social-insurance calculation. It does not replace the HSM job condition or lengthen the IND deadline.

Evidence and mistakes

Keep

  • Signed termination or end-of-contract document.
  • Residence card and prior permit history.
  • New sponsor application or notification evidence.
  • IND correspondence near the deadline.

Avoid

  • Starting the clock from the last active workday when the contract ends later.
  • Adding 6 months to a pre-22 May 2026 job loss.
  • Ignoring an earlier residence-card expiry date.
  • Assuming WW extends the immigration window.
